Welcome to Balloonixy (“Balloonixy,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Balloonixy website, online store, social media pages, and any related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must stop using the Services immediately.

1. Eligibility

You must be at least 18 years old—or the age of majority in your jurisdiction—to make purchases or enter into a contract through the Services. By using the Services, you represent that you meet this requirement.

2. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:

Balloonixy offers balloon décor, balloon gift boxes, event items, and related products/services. All descriptions, pricing, availability, and service offerings are subject to change without notice.

We make reasonable efforts to accurately display product information, but we do not guarantee that:

• Colours, sizes, or materials are perfectly represented on your device
• Product availability is accurate
• Pricing or promotional information is error-free

If an error occurs (including pricing, product availability, or service details), we reserve the right to correct it and/or cancel any orders affected.

4. Orders & Payment

By placing an order, you agree to provide accurate, current, and complete information.

We reserve the right to:

• Limit or cancel orders
• Refuse orders that appear to be placed by bots or unauthorized resellers

All payments must be made through the payment methods provided at checkout. You authorize us and our payment processors to charge your selected payment method for the total amount indicated at checkout.

5. Refunds, Returns & Cancellations

All cancellations, returns, and refund requests are governed by our Return, Refund & Cancellation Policy, which forms part of these Terms.

6. Event Deliveries, Installations & Responsibilities

If you book balloon décor, installations, or event delivery:

• You are responsible for providing accurate delivery details, access instructions, and contact information.
• Balloonixy is not liable for delays caused by incomplete or inaccurate information provided by you.
• Balloonixy is not responsible for damage caused by weather, improper handling after delivery, venue conditions, animals, or customer negligence.
• Latex balloons can pose a choking hazard; you agree to keep balloons away from small children and pets.
• Once delivered or installed, all items become your responsibility unless otherwise stated in writing (e.g., rentals).

7. Intellectual Property

All content on the Services—including logos, photos, product designs, text, graphics, and layout—is owned by or licensed to Balloonixy and protected by copyright, trademark, and other applicable laws.

You may not:

• Copy, reproduce, or use our content for commercial purposes
• Modify, distribute, or publicly display our materials
• Use our branding or likeness without written permission

8. User Submissions (Reviews, Uploads, Testimonials)

If you submit reviews, photos, or other content (“User Content”), you grant Balloonixy a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and share that content for marketing, promotional, or operational purposes.

You represent that:

• You own or have permission to share the User Content
• Your submission does not infringe the rights of any third party

9. Third-Party Links & Apps

Our Services may contain links to third-party websites or apps (including Shopify apps, delivery plugins, booking tools, etc.). We do not control or endorse these third parties and are not responsible for their content, policies, or actions.

10. Limitation of Liability

To the fullest extent permitted by law:

• Balloonixy is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services or products.
• Balloonixy’s total liability for any claim shall not exceed the amount paid by you for the product or service in question.

We are not responsible for:

• Delays or issues caused by third-party apps
• Delivery delays caused by weather, traffic, or circumstances beyond our control
• Damage to balloons after delivery or installation
• User negligence or improper handling

11. Indemnification

You agree to indemnify and hold Balloonixy, our employees, owners, and agents harmless from any claims, damages, losses, liabilities, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your breach of any law or rights of a third party

12. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your information.

13. Termination

We may suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to Balloonixy or other users.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and applicable Canadian federal laws, without regard to conflict-of-law principles.
